Yellow® Search Engine Marketing

"Money Back Guarantee" Terms & Conditions
All our services, including the Yellow® Search Engine Marketing service, are provided in accordance with our Terms of Business as set out on our web site at yellowpagesgroup.co.nz/terms (as updated from time to time), incorporating any additional terms and conditions referred to on or linked from that site. This includes, but is not limited to, the Yellow® Search Engine Marketing Terms and Conditions.

The terms below also apply where you are eligible for our Yellow® Search Engine Marketing "Money Back Guarantee". Terms not otherwise defined below have the meaning given to them in the Yellow® Search Engine Marketing Terms & Conditions. Any inconsistency shall be resolved in the following order of precedence:
  • These Yellow® Search Engine Marketing "Money Back Guarantee" Terms & Conditions;
  • The Yellow® Search Engine Marketing Terms & Conditions; and
  • Our Terms of Business.
Eligibility
"Landing Page" is a website operated by us on your behalf, that is not indexed by Google™, and is designed for the purpose of converting and tracking visitors from a Google AdWords™ campaign. To be eligible for our Yellow® Search Engine Marketing "Money Back Guarantee":
  • You must subscribe to our Yellow® Search Engine Marketing service on or before 14 December 2012;
  • You must use our Yellow® Search Engine Marketing service for a minimum term of 4 months ("Minimum Term");
  • You must have a Monthly Budget of at least $250 throughout the Minimum Term; and
  • Your Yellow® Search Engine Marketing service must include a Landing Page throughout the Minimum Term.
You will not be eligible for our "Money Back Guarantee" if you:
  • Have not paid any amount owing to us by you by its due date; and/or
  • Terminate our Yellow® Search Engine Marketing service prior to the completion of the Minimum Term.
Money Back Guarantee
"Lead" means each time an end-user: (a) clicks on a field on the Landing Page to reveal your phone number; (b) clicks on a link on the Landing Page in order to navigate to your website; or (c) submits an enquiry to you via the web form on the Landing Page (whether the web form is partially or wholly completed). Leads shall be measured by us, and our determination shall be final. If, at the completion of the Minimum Term, you have not received an average of at least 5 Leads per month over the Minimum Term, we will refund all amounts received by us from you in respect of your Monthly Budget throughout the Minimum term.

Variation
We reserve the right to vary, extend or withdraw our "Money Back Guarantee" at any time, for any reason.
